Renewable Energy Site Lease Agreement
An agreement securing the right to own and operate a renewable energy system on someone else's property is essential when the real property owner and renewable energy system owner are different parties. Sometimes this takes the form of a property owner leasing out its land to a solar project, other times it is a site lease for a wind farm, and still others a lease for less common types of renewable technologies. The issues involved in all of these site leases are similar. The Renewable Energy Site Lease Agreement should cover right of use, access, and O&M needs for the system, certain system and energy output ownership protections, important tax provisions defining the environmental attributes, incentives, and tax credits, lendor protections and rights, interconnection provisions, rent, indemnity, limits of liability, insurance, assignment and termination. This comprehensive Renewable Energy Site Lease Agreement covers all of these provisions and more.
